All i can see here is a forum on the same general subject ? i see no copied posts or even copied sections sub sections etc.
You can not expect no one else to make a forum on the same subject as yourself.. we have tons of forums on the same subject all running smoothly . |

Would the memberlist prove anything, what could I do to make my case stronger. Bring people from my fourm here? Edit: not to mention our forum "Spinnwin" was always called SNW for short. What is their site called? "SNW" look at the banner images of each site. |

What is your case ? You say someone copied your forum ? as i said all i see is two forums on the same subject, there is nothing wrong with that . As said before there are many forums on the same subject take swapitshop for example there is over 30 of them ,, football there is over 100 . you can not stop someone else having a forum that is on the same subject as yours. |

I have no problem with them talking about motorsports. What I do have a problem with is them using our name of Spinnwin.
I would love to show you more proof, but sadly, they have banned my IP from their site, probably because I was given a link to the site. Some people left our forum when I was given admin, and became the leader, if need be I can bring other people in to show that fact. I had to wipe my forum a few months ago because many of them came raiding in and spammed my site nonstop. |

This new forum is not using your name .
the links are to topics that discuss that they use to be at the old forum and then they name it. There is nothing wrong with this at all.. It seems as if this is nothing more than a breakaway forum , based on the same subject with many of the same members.. No rules have been broken |

Unless a name is trademarked, then that is the law. We can and do draw firm lines about copyright theft, but not against people using similar names for similar forums. | ||||

What he said was that there can be any amount of forums about the same subject. It looks like you are running your forum in a way that most of your users deem inappropriate, or at any rate they are preferring the new one. You are trying to force people to stay at yours by closing your rival down. That wont happen as they have done nothing wrong at all, and even if we did close it down they would certainly not go back to your forum but probably just set one up somewhere else (that is what my experience of these instances tells me). If I were you, I should concentrate on making your forum more appealing to others rather than trying to gain members by being the only one discussing your subject. Anything else from you is simply futile unless you can display anything more substantial as a complaint. |

You could try, and you would fail as even if such a forum had a membership that wanted to leave they would see such a name as a lame copy.
The forum you are on about is not named in quite such a way. Seems to me you would be better off figuring out why you have a problem rather than fussing about a not too closeness of names! |

Well, I am Sage's friend and all I can say is that they have stolen what was "SpinNwin"'s nickname and made a new forum using that. Also, they have banned me and Sage randomly but because we didn't agree with their views. | ||||

So you keep saying, but using a nickname of something might be mildly lame, but it is not the core of your problem. They are also free to have as members who ever they want.
You need to figure out if they are succeeding where you are not and if so why? Sometimes forums do just split. I can think of plenty that are happier as two forums than one. Both carry on okay. |

all I can see here is a general forum dispute... the 'new' forum has more members and posts than the 'old' one. I think it sounds like the forum changed ownership, people weren't happy and went and made their own to bring it back to how it once was. | ||||

We had 300+ members but due to them spamming us I had to wipe it all. | ||||

I had to delete it.
I also have PM's but since I deleted all the accounts (every day someone else spammed) all the names say "anonymous" now. |

There is never any call to delete your membership wholesale, and doing so will have predictable results.
You can use admin approval of registration, email bans and the mass user delete function to selectively and quickly delete spammers. |

This is what really happened, last august a very large and busy forum (spinnwin) was getting spammed, then the original owner re-took admin back, he gave it away to 2 other people. Then he revamped the forum...about 2 months later, there was a fight, and the Original Owner didn't want to deal with fights, so he gave his admin privileges to the first person who asked, which happened to be sage. People at the forum did not like sage, or how the original owner handled the situation, so they left. Sage is just trying to take down my forum out of spite, and for kicks and giggles. I created my forum to reunite all the members of the old spinnwin, with a new name "SNW" it has no relation to spinnwin whatsoever, it even states that in the forum rules. | ||||

I am going to lock this now. No doubt like all forum squabbles someone will insist there is yet another side to things, but we do not deal with forum squabbles here only real T&C/legal issues. |
