The forum has no posts ? so how can it be copy right infringements ?
copying someones layout is classed as bad, but no copyright infringements take place untill actual post are copied. |

I guess I don't understand.
Anyone can copy and pasted another persons forum, word for word, and that is not an infringement? Is he not presenting his forum as his creation? |

As i said before anyone can copy a layout, and if forums are about the same thing then yes titles and cats could be the same.. but as the forum has 0 posts , and none of those 0 posts have been copied from you, then Admin will not normally act, as it does not break our T@C |

Than YOUR T@C, is of no use to anyone. A complete word for word content theft is an infringement. Two forums about the same thing, do not have Titles and cats the EXACT same. Your member copied and pasted MY exact words and the order of MY forum. He is doing content theft and copyright infringement. Thank you again for your help |

Not all of it is word for word, I agree it is a rip off, but forum names and descriptions when the forum is about the same thing will tend to have a lot of overlap. Hence we nail people when they rip off actual content.
Someone prepared to be that lazy on layout will either get no posts, or be lazy enough to copy content. It all sorts itself out in the end. |

I think Mousetyme is right to bring this to our attention, it is indeed very close to the wire though I agree the wire has not been crossed yet.
I think it is one to keep an eye on, and Mousetyme, if he copies and pastes actual content such as rules, news articles etc then you should certainly bring that to our attention. I thank you for the report, I see your forum is very successful and I know that you must have put a lot of work into it, so I fully understand your anger here. |

I think we all do, but we have to remember there are no posts so far, so this is not even an "open" forum and it is not word for word, someone may simply be (still bad practice) using the copying as a template in developing their own spin on things.
I think our stance on content works, after all if they are copying then they are probably aiming at the same membership and anyone can see how lame they are if they copy the layout! It really does them no good at all anyway. |

He was definitely trying to get my members. As he spammed my forums with a link to his. He has been banned for life from mine.
There are only 2 forums he did not use from mine. VFK Buddy & the All About Disney. We do not have the admins listed as I made a gif that shows Sub Forums: The 3 items above are the only difference, Thank you again, for understanding, and I will be watching him very close for threads. Another small point to remember is that clobbering them early may just mean they set up elsewhere, if they are a rip off merchant there may be more satisfaction in letting them take the fall a bit later.
I certainly take that approach whenever fascists decide it is a good idea to set up here, there is a balance between letting them waste their time creating a forum and letting their forum exist, as soon as I feel they have wasted the time they get zapped
