Hi, the European Union recently introduced laws on guidelines on the use of cookies, since our forum/club has launched in the UK, we are potentially liable unless the law is adhered to which brings me to this wonder if myFF considered this legal requirement ?

The following requirements are taken from:

"Updated in May 2012, our cookies guidance (pdf) sets out the changes to the cookies law and explains the steps you need to take to ensure you comply. The updated guidance provides additional information around the issue of implied consent:

    * Implied consent is a valid form of consent and can be used in the context of compliance with the revised rules on cookies.
    * If you are relying on implied consent you need to be satisfied that your users understand that their actions will result in cookies being set. Without this understanding you do not have their informed consent.
    * You should not rely on the fact that users might have read a privacy policy that is perhaps hard to find or difficult to understand.
    * In some circumstances, for example where you are collecting sensitive personal data such as health information, you might feel that explicit consent is more appropriate.

Further, it would seem that where the website is hosted is of no relevance:

We are relying on implied consent for now.

The law about cookies is a nonsense. It is like outlawing roads because they can be used to deliver land mines

Cookies are used 90% benignly and vitally by websites.

The law has gone after a "mechanism" and missed the actual issue of "privacy".

Those you would invade privacy don't need cookies.

We are very involved at the beginning (of the beginning TBH)  of a heavyweight initiative on privacy which is the actual issue is.

Hi and thanks for the answer, sorry for not getting back sooner.

Understand the "implied consent" statement and agree with the overall lack of usefulness of the whole initiative.

Is the implied consent covered by the following statement in the terms and conditions ?

"This forum system uses cookies to store information on your local computer. Many thanks

That would cover it, though remember here, if anyone gets hit on over this, it will be us and not individual forums. Forum Index -> Terms and Conditions
