Hello,
  My husband owns Shade Tree Racing and has had that name since 1968(copywrited). I noticed you have a site here listed as shadetreeracing.myfastforum.org that has sex sites listed on it. My husband races stockcars and runs a online racing league and I dont think that this is conducive for the well being of his members. THIS NOT my husbands site. IF you could please remove it, my husband and I would be greatful for your cooperation in this matter.

Wouldn't it be free to use even after such, as long as it is a different topic?  Such as a game company having a registered trademark having the same name used by a band that is entirely unrelated?

It is a complex field, and one where when a name is trademarked the scope is largely defined by how aggressive the lawyers are.

As I recall, large swathes of the English Country side had to be towed into the mid Atlantic for disposal following the release of Lord of the Rings as someone had called them Shire country....
