I can't remember this one... we don't lose any rights to, say, art or writing that we post on our forums, do we? I wouldn't expect that we would, but I thought I'd make sure.

Interesting question. This cropped up years ago with one of the major services I believe. They had a neat little term along the lines of if you posted on their system you lost copyright of the post, ownership of your house and had to hand over your first male child
I think it got squashed before reaching the courts.

I think this is the real legal position, as between your members and you as admin.

You don't lose ownership of what you post... in fact I would say that posting it more than adequately establishes copywrite. However, most commercial publishers will not accept pre-published materials, and they include postings to forums as published material.

Some publishers don't care, and some will specifically ask you where else it has been published, but most will simply not accept any pre-published material. They get into way too much legal quag-mire if they do.


So if you are intending to publish a book or something... just beware.


Obviously, if you self-publish, you can make whatever rules you want!

You certainly do not lost copyright, but you do not actually "own" the post. e.g. by posting you give the forum owner the right to publish the post in the place it was posted. You cannot legally force the forum owner to remove a post that you no longer want published.

Sorry if I wasn't clear on that. By posting you are publishing the piece on the forum.. the forum owner is the implicit publisher. Though most forums, including this one, do not try to maintain any rights to the piece other than as stated by Admin... to keep it in context on the forum.

Hence the reason that many corporate publishers do not allow the publishing, or at least discourage it, of material which has been previously "published"

I'm not sure if the original poster wanted to publish his art/writing in a commercial manner or if he jsut wanted to make certain that intellectual rights were his.

Anyhow... Happy New Year! (almost!)
