Another infrigement on website

has been shamelessly copied in October 2007 here - http://nita.myfreeforum.org/ftopic285-0-asc-0.php

I am fed up of having to monitor this website for blatant copy and pasting of my posts.

The thread in question has now been removed to a non public part of the forum.
I hope this resolves this matter and apologies to myfreeforum for the inconvenience.

May I take this opportunity to point out that the forum has not in the past copied any material from the complainants forum, the 1st link posted points to a forum that is not connected to this one. Also may I add that the thread has been running for 18 months with out a complaint within that time, the complainant has even been a member of the forum for 15  months without ever complaining or bringing it to my attention before now. It seems to me he has some axe to grind and is trying to bring the demise of the forum via his complaints. Any way I hope this matter is now resolved and closed.

Moving the thread is not enough if a copyright violation has taken place, however there may be a case that tacic consent has been given.

But since the copied material was not posted by the copyright holder this is not an area I want to get into and would request the thread be removed.

However if your statement that the material has been know about for over a year and not complained about until now is true, then that fact will be given due consideration.

The thread may have been up for some time but I can hardly be expected to read every single post on a forum to see whether an infringement has occurred!
When I viewed the thread at the weekend it was the first time I had seen it.

If you want me to remove the thread I will, but may I just say that although the two threads do look similar they are just that similar. Ok the two threads ask a set of questions, it starts with the question "name" a universal question I would say. My forum asks an additional question "What is your favourite fly & why?". Although I do not want to deviate from the complainants complaint I must stress that no complaint has been received during the time the complainant has been a member of the forum, he joined in Feb 2008, the thread in question was started on 17 Oct 2007 and continued until 21 Nov 2007 when it was replaced by another thread titled "over to you part 2" which ran until 11 March 2008. As I said this member joined in Feb 2008 giving him amble opportunity to view, comment or complain about any alleged copyright infringement, something he chose not to do until now, and a decision I believe has been made out of malice. If you wish I can provide details of this member and details of the other part 2 thread (which I must say does not contain the original set of questions but has been removed from the public domain). For someone that claims to have to monitor the forum for "blatant copy and pasting of my posts." he has missed the one post that he takes offence to until now, this member has my email address and has the use of the PM facility but has chosen not to contact me to resolve the issue until now. I can not for one minute believe that a member who joins while this thread is running can claim to have missed not seeing it in the past.

May I ask that if admin do decide that a copyright infringement has been made, would it be ok to change the set of questions and entirely reword them or delete the questions that the complainant has complained about and replace them with a new set instead of removing the whole thread? reason being that the members of the forum have discussed some interesting topics not related to the original topic.

I will await your decision and co operate on any decision you make.

Then as already stated, the thread must be removed it is a copyright violation.

I have to flag up a basic concern that anyone would believe that issues of copyright theft somehow disappear if a thread is moved

They do not.

There is no guest permission to read whatever that is.

Copyright law in not that complex at its simplest level and a forum that does not copy other peoples work should not have problems.
